Deline v. Brooks et al

A developmentally disabled Massachusetts woman who developed Lithium toxicity while being treated for behavioral problems passed away before her condition could be alleviated. A civil claim was brought against multiple parties involved at various stages of her care. At the request of the defense, The Forensic Panel medical specialists reviewed records relating to the emergency and ICU care of the decedent.

 

The Forensic Panel’s specialists in emergency medicine, psychiatry, and critical care confronted a case in which the sad outcome of the case prepared all for a worst case legal outcome for the defense.  Our specialists uncovered obscure but pivotal evidence for contributory responsibility and demonstrated its relevance to standards of care that led to a resolution of the case far more favorably to defense than expected.
